Supporters Scheme - Terms and Conditions of Use
1 About our Terms
1.1 These Terms explain the Supporters Scheme of the Commonwealth War Graves Foundation (“Scheme”).
1.2 You should read these Terms carefully before joining the Scheme.
1.3 By joining the Scheme you agree to be bound by these Terms and the documents referred to in them.

Content means any text, images, video, audio or other multimedia content, software or other information or material submitted to or on the Site;
CWGC means the Commonwealth War Graves Commission, 2 Marlow Road, Maidenhead, SL6 7DX, UK;
CWGF means the Commonwealth War Graves Foundation, 2 Marlow Road, Maidenhead, SL6 7DX, UK;
Terms means these terms and conditions of use as updated from time to time under clause 10;
Supporter’s Area means the restricted area of the Site only accessible to Scheme members;
Scheme Benefits means the benefits that members may access or receive as determined from time to time by us, including but not limited to access to the Supporter’s Area;
Site means www.cwgc.org, and all associated web pages;
We, us or our means The Commonwealth War Graves Foundation, 2 Marlow Road, Maidenhead, Berkshire, SL6 7DX, UK, a charity registered with the Charity Commission in England and Wales with registration number 1171947;
You or your means the person joining the Scheme.
1.8 Your use of the Site means that you must also comply with our Privacy, Cookie and Online terms and conditions for the supply of goods policies, where applicable.
2 Membership Levels of the Scheme
2.1 We offer a single level of membership to the Scheme:
2.1.1 Supporter of the Scheme – annual membership for individuals
2.2 Membership of the Scheme is managed and regulated by us and we reserve the right to alter or amend these Terms at our discretion.
3 Supporters of the Scheme
3.1 In return for a designated minimum donation, as determined by us from time to time, private individuals may become a Supporter of the Scheme.
3.2 You must be aged 18 years old or over to become a Supporter of the Scheme.
3.3 Membership as a Supporter of the Scheme is on an annual basis. Your membership shall be renewed automatically on the anniversary of your joining the Scheme unless you notify us of your wish to cancel your membership at least seven days in advance. We will send you an email reminder at least 14 days before your anniversary to remind you that it will automatically continue and money will be taken from your account unless you cancel.
4 Gift membership
4.1 You may apply for membership as a Supporter of the Scheme as a gift on behalf of another person providing that the intended member is eligible under these Terms.
4.2 An application to gift membership will be processed through the Site and the recipient will receive a unique voucher code to complete the registration process.
4.3 In the event that the recipient does not accept the gift membership within one month, you may apply for a refund of any donation made for the gift membership.
4.4 No refund will be made in the event that the membership of the recipient of the gift is subsequently terminated or suspended under these Terms.
5 Scheme Benefits
5.1 Membership of the Scheme for Supporters allows access to the Scheme Benefits.
5.2 The Scheme Benefits shall include access to the Supporter’s Area and other benefits as we determine from time to time.
5.4 While we aim to ensure that all members enjoy the Scheme, we cannot guarantee the availability of the Scheme Benefits at all times and accept no liability for any loss due to the interruption, suspension or termination of any Scheme Benefits.
5.5 While we aim to ensure that all members enjoy the Scheme, we absolutely reserve the right to alter, amend, terminate or replace any Scheme Benefits at any time with or without notice.
6 Supporter responsibilities
6.1 You agree that you are solely responsible for:
6.1.1 all costs and expenses you may incur in relation to your membership of the Scheme; and
6.1.2 keeping your password and other account details confidential.
6.2 Membership of the Scheme is individual and non-transferrable.
6.3 We may terminate or suspend your membership of the Scheme if you do not comply with any part of these Terms, any terms or policies to which they refer or any applicable law. Any termination or suspension of membership shall not give rise to a right to refund of any donation made to us.
7 Limitation on our liability
7.1 Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury), we are not legally responsible for any:
7.1.1 losses that:
(a) were not foreseeable to you and us when these Terms were formed; or
(b) that were not caused by any breach on our part
7.1.2 business losses; and
7.1.3 losses to non-consumers.
8 Events beyond our control
We shall have no liability to you for any breach of these Terms caused by any event or circumstance beyond our reasonable control including, but not limited to, strikes, lock-outs or other industrial disputes; breakdown of systems or network access; or flood, fire, explosion or accident.
9 Rights of third parties
No one other than a party to these Terms has any right to enforce any of these Terms.
These Terms are dated 15th May 2017. No changes to these Terms are valid or have any effect unless agreed by us in writing. We reserve the right to vary these Terms from time to time. Our updated terms will be displayed on the Site and by continuing to use and access the Scheme following such changes, you agree to be bound by any variation made by us. It is your responsibility to check these Terms from time to time to verify such variations.
These Terms are dated 15th May 2017. No changes to these Terms are valid or have any effect unless agreed by us in writing. We reserve the right to vary these Terms from time to time. Our updated terms will be displayed on the Site and by continuing to use and access the Site following such changes, you agree to be bound by any variation made by us. It is your responsibility to check these Terms from time to time to verify such variations.
12.1 We will try to resolve any disputes with you quickly and efficiently which may be submitted in person, by letter or email to the contact details in 1.4
12.2 If you want to take court proceedings, the relevant courts of the United Kingdom will have exclusive jurisdiction in relation to these Terms.
12.3 Relevant United Kingdom law will apply to these Terms.
